This defect appears in ODF 1.2 CD04-rev09 and earlier versions. The section numbering and specific content described is that for CD04-rev09 in order to be specific.

Proposal:

If the observations in the note are consequences of the schema and other provisions of the specification, reword the note as informational. E.g., "Note: List items do not contain sections. ... ." This should be applied throughout the paragraph.

[Side note: It would be permissible to use can and cannot from the ISO JTC1 nomenclature, but I think it is preferable to not use such language at all within the note.]
