section 8.1 require disclosing to OASIS in writing any patents a TC member
has
that might read on the essential claim.
There are several issues here as they are applied to the virtio TC:
- Documenting in writing is hard to implement
- OASIS has not been diligent in forwarding the disclosures to the TC.
Of several disclosed by Red Hat, only part have been uploaded to
TC ipr page, and none at all have been forwarded to the mailing list.
Further, the TC operates in a non-assertion mode, so existence of patents by
TC
members is essentially irrelevant for people implementing the specification.
So this requirement places a lot of burden on members adding new
functionality to virtio without any real benefit to the community.
If you agree that the TC should drop the disclosure obligations
as listed in the IPR guidelines section 8.1, please vote yes.
If you disagree, please vote no.
